Vervaet, 33 Bijah’s Way (7-95)  The Board reviewed a well permit application submitted by John Clark of Island Water Source.  The proposed well is located 10’ from the old well.  Marina Lent assured the Board that John Clark will provide documentation of the proper abandonment of the old well. The Board approved the permit application.

Chilmark Tavern, 9 State Road, (30-83)  The Board took note of a Title 5 inspection report for the tight tank sewage disposal system serving the Tavern.  Mike Renahan pointed out that the only way to definitively confirm that the tanks are not leaking is to conduct a pressure test.  The Board asked Marina to look up the water meter readings in relation to volume pumped during the 2010 summer season and report back to the Board.

Hoxie, 14 Marjos Way (27-2)   The Board took note of a Title 5 inspection report submitted by Doug Cooper.  The system passes, however, Mike Renahan pointed out that the system had most likely not seen any use for a few months prior to the inspection.

Chilmark Community Center Public Water System #4062006  The Board approved an Action Plan prepared by Marina Lent in response to  notice of non-compliance # NON-SE-11-5D079, dated May 27 2011, regarding MCL violations for coliform bacteria for the months of February and March 2011.

Chilmark Community Center Art Shack sink Elise Elliston, the architect in charge of renovations to the Community Center Art Shack, met with the Board to discuss plumbing questions related to the proposed art shack sink.  She reported that plumbing inspector George Apostolides had pointed out that the proposed system lies within 10’ of the building, and therefore falls under the plumbing code, rather than Title 5.  He further noted that plumbing for the sink may have to conform to standards for industrial rather than household waste, that a 3” vent pipe is required, and that proximity to the public water system well puts the system in Zone I, where all discharge would have to have prior approval of the DEP. She further reported on a conversation with Kent Healy, who had explicitly warned against any measures that could lead to an increase in flow to the existing septic system.

She therefore wondered whether the planter-box should be moved to a distance >10’ from the shack, and suggested that the pipe leading from the sink to the box could be enclosed and covered by a wooden bench.

Katie Carroll felt that any elaborate construction should be strictly avoided, especially within the 100’ Zone I of the well.  Mike Renahan felt that a small pump would enable the pipe to the planter to be placed below grade, which would be preferable.  Jan Buhrman preferred a gravity-fed system.

Elise Elliston then suggested that the planter box could be moved to the front of the Art Shack, where it would no longer be within the Zone I of the Community Center’s public water system well.  In this location, it would have the further advantage of screening and shielding the kiln, and it could also host the large rose bush currently located at the side of the shack.

After some discussion, the Board suggested that Elise Elliston suggest this location to George Apostolides, and, with his acquiescence, build the planter system.  The performance of the system could be re-evaluated after the summer.

The Board decided that only non-toxic chemicals may be used in the Art Shack.

Walsh, 320 Middle Road, (25-11)  The Board approved a well permit application submitted by John Clark, with a plan produced by Reid Silva, for this property.  The plan calls for a proposed well location 128’ from the septic reserve area.

Zoia, 18 Point Inner Way (33-114)  The Board heard from Chris Alley (Schofield, Barbini & Hoehn), who asked for a letter from the Board to the Site Review Committee to the effect that the gazebo and boathouse, which were being rebuilt in their original size and configuration, with only 3’ added to the boathouse, were not counted as bedrooms for purposes of the Zoia sewage disposal system.  Chris Alley and Thomas Tate also conveyed a request to be able to install sinks in the barn at the Zoia property.  The barn already has an outdoor shower.

The Board denied the request for sinks in the barn, and asked Marina Lent to review recordings of the Board’s conditions at approval of the septic system to determine whether outdoor water is permitted at the barn. The Board also requested that Marina Lent seek out a legal opinion from the DEP as to whether an outdoor shower and/or outdoor faucet with hose-bibb adapter which are not connected to the sewage disposal system are to be considered “waste-water” or not.

Davidson, 5 Shotneigher Lane, (34-1.1)  The Board took note of a Title 5 Inspection Report for the property.  The system passed inspection.

Heinemann, 26 Cygnet Way (24-33.1)  The Board took note of an as-built letter for the sewage disposal system on this property

Jones/Snider, 26 Abel’s Neck Road (31-2) The Board took note of a FAST Field Inspection and Service Report for the sewage disposal system on the property.

Lindauer, 2 Marsh Road (27.1-26) The Board took note of a FAST Field Inspection and Service Report for the sewage disposal system on the property.

Mohair, 5 Rhythm Road (7-1.1) The Board took note of a Title 5 Inspection Report for the property.  The system passed inspection.

2011 Food Establishment Permits:   The following establishments were inspected and permitted for the 2011 season: :   The Bite, The Chilmark Tavern, The Homeport Restaurant

Food Events and Catered Event Plans:  Community Church Lobster Rolls, Tuesday nights; Warshaw, 6/12 and 6/19, Old King’s Highway (MV Clambake);  Rose Leitner Beach Clambake, 6/11, Quansoo, (MV Clambake);  

Septic Installer Permits:  John Kosboski, Eastern Excavation;  

Tier 3 Bathing Beach testing status was granted by the Department of Public Health for Menemsha Beach and Great Rock Bight

Expanded Bottle Bill deposit and recycling at Menemsha: In response to an inquiry from Executive Secretary Tim Carroll, Board of Health Chairperson Katie Carroll suggested that the Town make recycling stations available in Menemsha.

MVRD:  The Board noted that earnings from the sale of dump stickers exceed charges for transportation and recycling.  Net earnings will be returned to the Town at the close of the fiscal year.

Perc Season: The Board decided to close the 2010/2011 perc season, effective immediately.

Mosquito Education Flyer  The Board asked Marina Lent to make education materials available to children at the Chilmark School to take home on the need for precautions against mosquito-borne diseases.

Ice Machine in Menemsha: The Board noted that a new tenant on the Menemsha docks, who is producing ice for chilling fish, was considering the packaging and sale of ice as a consumer product.  The Board stated that such sale could not be permitted without a valid wholesale license, which must be issued by the Massachusetts Department of Public Health.
